1. Your Travel Booking
Whether you book alone or as a group, we will only deal with the lead booking name in all subsequent correspondence, including changes, amendments and cancellations. You must be 18 years old at the time of booking and possess the legal capacity and authority to book as the lead name and travel on holidays with us and take up the offers advertised by us if they are still available. You are responsible for ensuring the accuracy of the personal details or any other information supplied in respect of yourself and any other person travelling on the booking and for passing on any information regarding the booking or any changes made in relation thereto, to all persons travelling on such booking, including but not limited to information on schedule changes or copies of booking confirmations.
It is a condition of your booking with us that you and all other members of your party, including infants and children, are adequately insured on holiday. Any person who is under 18 years old must be accompanied by an adult on his or her journey. There may be other restrictions and conditions on some offers, but these are explained in the details of those offers. When you or (if you are booking through a travel agent) your travel agent ask for your booking to be confirmed, we will confirm the booking there and then, and set aside your chosen accommodation, holiday or transport for you. Next, we will send you or your travel agent a Confirmation Invoice within 14 days. We may not be able to confirm some of our ground arrangements straight away (e.g. bespoke accommodation, tours etc). In these instances we may issue a Confirmation Invoice. However, a contract for arrangements that have not been confirmed on that invoice will only be made when we have sent you written confirmation that those additional arrangements have been completed. If there is any change to any of the details discussed at the time of booking, before the Confirmation Invoice is issued, we will notify you promptly of any new or changed details, including a change to the total price (if any). If any detail on the Confirmation Invoice is not correct tell us or your travel agent immediately. If there is an obvious error on the Confirmation Invoice we reserve the right to correct it as soon as we become aware of it, but we will do this within 7 days of issuing the Confirmation Invoice or, if your departure is within 7 days, no later than 24 hours before you go.

2. Your Contract with “Learning Holiday by Platypus Itinerary” (Reg.782765):
When you make a booking with “Learning Holiday by Platypus Itinerary”  you undertake that you have the authority to accept and do accept these booking conditions on behalf of yourself and your party. A contract will exist upon our accepting any monies from you towards the booking, or upon the issue of our Confirmation/Invoice, whichever is the earlier. These conditions in conjunction with the information set out in our published literature or website form the entire agreement between yourself and ourselves.

3. Making a Booking
When you or your travel agent makes a booking with “Learning Holiday by Platypus Itinerary” and we accept it, you must immediately pay a deposit of 30% of the total amount per person whichever is greater in respect of the services supplied by “Learning Holiday by Platypus Itinerary”.
After we receive your deposit or balance a confirmation/invoice will be sent to you or your travel agent setting out all the travel arrangements and balances remaining. Balance must be paid in full no later than 30 days prior to departure. If you are departing within 30 days then the total cost of the holiday is payable in full when the booking is made. If either deposit or balance is not paid on time we reserve the right to cancel your arrangements with “Learning Holiday by Platypus Itinerary” Payment retained by “Learning Holiday by Platypus Itinerary” in the event of cancellation must be no more and no less than the cancellation charges set out in clause 5 below.

4. Prices
All prices shown online are in Euros per person per night (unless otherwise stated) based on 1 or 2 people sharing a twin or double room for one or more consecutive night stays, except for certain holiday periods where a minimum 2, 3 or 5 night stay may apply. These rates apply to pre-booked leisure stays only.
All prices include Value Added Tax at the current prevailing rate.
Prices are subject to change without notice. However, your price is guaranteed once you are given a confirmation number.
For the avoidance of doubt, your price does not include any incidental charges, which you may incur during your stay (including, by way of example only, in respect of your use of the hotel's bar and mini-bar facilities and the costs of external telephone calls from your room). Such charges will be payable by you on your departure and, in the event that you fail to pay any such incidental charges, it is a condition of your contract with “Learning Holiday by Platypus Itinerary” that you irrevocably authorize “Learning Holiday by Platypus Itinerary” to debit your credit or debit for the amount of any shortfall.
Prices are fixed at the time of booking and generally will not be subject to surcharges. The only exception to this will be an increase in our costs arising as a result of any government action including but not limited to new or increased taxes such as VAT. Should you decide to cancel because of this then you must exercise your right to do so within fourteen days from the date we advised you or your travel agent of the amount due.
We reserve the right to change our prices at any time before you book including any special offers we may from time to time have which may not be the same as set out in our publicity material.

5. What the Price Includes:
Website prices include twin or double bedrooms (single room for single guests) with colour TV, direct dial telephone and private en suite bathroom.
The prices shown online are not valid in conjunction with any other offer and, until you have received your confirmation number, are subject to change without prior notice.
6. Availability:
Availability of rooms at the rates shown online may be limited and/or restricted to certain periods.
During major sporting events, social events, conferences and exhibitions, the same rates may not be available.
7. Feature Rooms:
At many of our hotels you can, on payment of a supplement, upgrade your accommodation to a feature room or a suite, on a per room per night basis. Please ask for details.
8. Single Guests:
Individual guests using a single room (where available) are charged the standard per person rate and single supplement rate, as shown online. When no single room is available, individual guests may book a double or twin room and pay a single occupancy supplement
For certain hotels, the supplement may be equivalent to the rate charged for a second person's stay.
9. Changes by You
If you wish to change your booking with “Learning Holiday by Platypus Itinerary” in any way, and we can accept the change, a charge of £40.00 per person per amendment will apply provided that your instructions in writing are received two months or more prior to departure. Thereafter, except as provided by applicable law, cancellation charges, as specified in clause 5 below, apply.

10. Guests with Impaired Mobility:
A number of our hotels offer modified facilities for guests with impaired mobility. Others, whilst not having special facilities, have mainly level access to public areas and accessible bathrooms. Guests with impaired mobility or other particular requirements should check with their chosen hotel in advance that their requirements can be met.

11. Dogs:
Certain of our hotels are able to accommodate dogs, at the manager's discretion, in some cases for an extra charge. Please call the hotel direct for details.
12. Car Parking:
Car parking is free at most of our hotels, but at some sites there is limited availability. For further information on parking availability and charges, please call the hotel direct.
13. Checking In and Out:
Arrival and Departure
Hotel rooms are available from 14.00 hrs on the day of arrival. Rooms must be vacated by 10 a.m. the day of departure, unless otherwise sanctioned at the discretion of the hotel manager. For certain of our hotels, these times may differ. Please ask for details of the arrival and departure times when making your booking.
14. Meal Arrangements:
In most of our hotel listed the Half board service includes breakfast and dinner. It will be possible to have lunch only at some of the hotels, with the full board service. At some hotels is only possible to have breakfast and dinner is provided at a restaurant out of the hotel, where the director has a special agreement for his guests. Please ask our staff details about meals, before making a reservation.
15. Health, Leisure and Beauty:
Many of our hotels have excellent leisure facilities (which are free for guests) such as swimming pool, steam room, sauna and jacuzzi (the availability and range of facilities varies from hotel to hotel). Please check the availability and range of facilities at your chosen hotel when placing your booking. A charge will be made for the use of certain facilities, such as solaria, exercise classes and beauty treatments. Your use of such facilities is subject to any particular terms and conditions applying at the hotel at which you have placed your booking.
Under 16s are not permitted to use the gymnasium (where available) and must be accompanied by a responsible adult at all times when using any other available leisure facilities.
Under 5s are not permitted to use spa pools, saunas, solaria and steam rooms.

16. If we cancel your booking
We aim to provide your accommodation as booked. But if, for example, you do not pay the balance of the accommodation price on time, we may cancel it. We reserve the right to cancel your booking in any circumstances but if we cancel your booking you can either have a full refund or accept replacement accommodation from us of equivalent or closely similar standard and price (if one is available).
Should you choose this option the terms and conditions of your holiday will not change and these conditions will still apply to your booking. and we will always refund the difference in price if the replacement accommodation is of a lower standard and price. Other than in the case of non-payment, we will not cancel your booking less than two weeks before you go, unless this is the result of an event that is out of our control, such as war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, hurricanes and other actual or potential severe weather conditions, and any other similar events.

17. If you cancel your booking
You or any member of your party may cancel your booking at any time providing that the cancellation is made in writing by the person who made the original booking and is communicated to us either direct, or via your travel agent. You will receive a refund of the amount paid (excluding any amendment charge) less the cancellation fees specified below. Refunds are made only through the original booking office:
Booking amendments or cancellations must charged for according to the details of our terms and conditions.

18. Cancellation charges
These charges are based on how many days before your booked departure we receive your cancellation notice. These charges are a percentage of the total cost of your booking, not including your insurance premium.

19. If we amend your booking
The remainder of this document forms part of your contract with “Learning Holiday by Platypus Itinerary”.
As we do not control the day-to-day management of your accommodation, it is possible that we may be advised that the reserved accommodation may not be suitable or available to you upon arrival at your destination. If this happens, we will endeavour to provide accommodation of at least the same standard in the same resort area. If only accommodation of a lower standard is available then we will refund the difference between the accommodation booked and that available together with compensation of £15.00 per person for any inconvenience.
IMPORTANT NOTICE: We are only responsible for services booked by “Learning Holiday by Platypus Itinerary” and we are not responsible for changes which arise as a result of events outside of our control, such as technical or maintenance problems with means of transportation, war or threat of war, civil strike, industrial disputes, natural disasters, bad weather or terrorist activity.
20. If we cancel your booking
We reserve the right in any circumstance to cancel your booking. However, in no case will we cancel your booking less than 8 weeks prior to departure unless it is for reasons outside of our control or for late or non-payment by you.
If we have to cancel your hotel booking (other than for late or non-payment by you) you will have a choice of taking an alternative hotel, (where this is of a lower price we will refund the difference to you, however, if the hotel is of a higher price you will be expected to pay the difference) or canceling the contract in which case a full refund will be paid to you. Occasionally we will have to cancel a trip due to under booking. If a tour is cancelled due to under booking then we will inform you no later than 8 weeks prior to departure.

21. Our liability
(I) Our obligations, and those of our suppliers providing any service or facility involved in any part of your Holiday or Excursion, are to take reasonable skill and care to arrange for the provision of such services and facilities and, where we or our supplier is actually providing the service or facility, to provide them with reasonable skill and care. You must show that reasonable skill and care has not been used if you wish to make any claim.
(II) For claims which do not involve death or personal injury, we accept liability, subject to paragraph (I) above and (IV) below, should any part of your Holiday or Excursion not be as described in the brochure or elsewhere by us before you leave your Country. If we accept liability, we will, subject to paragraphs (V) and (VI) below, pay you reasonable compensation in accordance with Italian low. However, the maximum we will pay you in any circumstances is twice the price of the original Holiday or Excursion cost. This maximum will only be payable when every aspect of your Holiday or Excursion has gone wrong and you have not received any benefit from your Holiday or Excursion. (III) For claims which involve death or personal injury as a result of an activity forming part of your Holiday or Excursion, we accept liability subject to paragraph (I) above and (IV) below. If we accept liability, we will, subject to paragraphs (V), (VI) and (VII) below, pay you reasonable compensation in accordance with Italian Law.
(IV) We accept liability in accordance with paragraphs (I), (II) and (III) above and subject to paragraphs (V), (VI) and (VII) below except where the cause of the failure in your Holiday or Excursion or any death or personal injury you may suffer is not due to any fault on our part or that of our servants, agents or suppliers, and is either attributable to you, or attributable to someone unconnected with the Holiday or Excursion and is unforeseeable or unavoidable, or due to unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised, or an event which neither we, nor our servants, agents or suppliers could have foreseen or forestalled.
(V) Where a claim (whether for personal injury or non personal injury) arises out of loss or damage suffered during the: courses, excursions, hotel accommodation, the amount of compensation you will receive will be limited in accordance with and/or in an identical manner to the provisions of any relevant International Conventions, namely the Warsaw Convention 1929 (including as amended by the Hague Protocol) the Berne Convention 1961, the Athens Convention 1974, the Geneva Convention 1973 and the Paris Convention 1962. You can get copies of the relevant conventions if you ask us. For the avoidance of doubt, this means that we are to be regarded as having all benefit of any limitations of compensation contained in any of these Conventions or any other international conventions applicable to your Holiday or Excursion.
(VI) You are obliged to assist us in recovering from any third party any sum which may compensate us for any sums we pay you. In particular, you are obliged to assign to us any rights that you may have against any other person whose acts or omissions have caused or contributed to our legal liability to pay you compensation. You must also provide us with all assistance we may reasonably require. Finally, you must follow the procedures for the notification of complaints set out in the clause below entitled “Complaints”.
(VII) Should you become ill while on Holiday, you must, in addition to reporting your illness to our representative, consult a local doctor and also consult your GP upon your return to the UK. Should you then wish to make a claim against us as a result of that illness, you must provide us with details of both the local doctor whom you saw and your GP, together with written authority for us to obtain a medical report from both those doctors.
(viii) If you or any member of your party suffers illness, injury or death, through misadventure, as a result of any activity which does not form part of your contracted Holiday or Excursion arrangements, we will provide you with all reasonable assistance. This assistance may include our making a contribution towards your initial legal costs in taking action against the person/s) responsible providing you request this within 90 days of the incident in question. All assistance (financial or otherwise) is subject to our reasonable discretion and a maximum total cost to us of £ 500 per booking form. If you are entitled to have any costs and expenses arising from such an incident met by or from any insurance policy or if you obtain a costs order against anyone in relation to the incident, you must repay to us the costs and expenses we spend in assisting you.
(IX) Other than as set out above, and as is detailed elsewhere in these booking conditions, we shall have no legal liability whatsoever to you for any loss, damage, personal injury or death which you suffer arising directly or indirectly from any aspect of your Holiday or Excursion.

22. Conduct While Travelling
We reserve the right to refuse to accept you as a customer or continue dealing with you if your behaviour is disruptive or affects other travellers or is threatening or abusive towards our staff or agents, on the telephone, in writing or in person. If the Captain of your ship or our representative staff believes that you could be disruptive or that you are suffering from a contagious disease, they can also refuse to let you proceed with your travel arrangements or restrict your movements on board or disembark you from a ship. If you are disruptive under the effect of alcohol or drugs, we will treat your booking as cancelled by you from that moment, and you will not receive any refunds and will be obliged to pay full cancellation charges. If this occurs abroad, you will become responsible for your own return home and any other members of your group who cannot or will not travel without you. In any of these circumstances no refunds or compensation will be paid to you and we may make a claim against you for any costs and expenses incurred as a result of your behaviour e.g. the cost of diverting an aircraft or ship to remove you. Criminal proceedings may also be instigated.

22. Your accommodation
When you book accommodation (whether provided or not) its availability or provision is subject to the ‘house rules’ of the hotel or other accommodation providing or undertaking to provide such accommodation.Any accommodation we arrange for you must only be used by those people named on your Confirmation Invoice (or on latest Amendment Invoice issued). You are not allowed to share the accommodation or let anyone else stay there. You are responsible for the cost of any damage caused to your accommodation or its contents during your stay,. These charges must be met by you and may have to be paid locally.

23. Documentation
Where travel and health documents are necessary to comply with the requirements of the country you may wish to visit then it is your responsibility to procure them. If failure to obtain any such documents results in fines, surcharges or any other financial penalty, being imposed upon us then you shall reimburse us accordingly. You must ensure, by consulting your own Doctor if necessary of specific precautions deemed prudent for the country/resort you intend to visit and the appropriate medication/inoculations are complied with.

24. Contacting you
If you book via our website or have opted in other circumstances for us to contact you via e-mail, we will communicate with you using the e-mail address you have provided. For example, to provide your e-confirmation, e-ticket, e-cancellation, etc. We will assume that your e-mail address is correct and that you understand the risks associated with using this form of communication. Please note that you may still have to contact us via our call centre or in writing as required in our terms and conditions

25. Unused services
No refund will be due to you in respect of non-utilization of any part of the excursion, arrangements, courses, meals and other services not consumed made for you.

26. Insurance
We cannot stress enough the importance of your taking out adequate holiday insurance against cancellation charges, unexpected curtailment of your holiday, medical expenses arising overseas, loss or damage to luggage and personal liability claims against you.
Should you elect not to effect suitable travel insurance cover despite this advice, then you undertake on behalf of yourselves and all members of your party to indemnify both ourselves and our travel agents and representatives (as applicable) for any costs that arise which would otherwise have been met had such insurance cover been taken out

27. Complaints
We do our very best to ensure that your holiday arrangements go according to plan. However, if you have a complaint arising out of what we have agreed to provide for you please let us know at the earliest opportunity, if necessary by telephoning our office from wherever you may be. If a problem arises during your Holiday, Courses or Excursion it is important that you advise the supplier and/or our representative at the earliest opportunity who will endeavour to put things right.
If your complaint cannot be resolved locally you should advise us within 28 days of the incident, in writing, giving your original booking reference number and all other relevant information. Your letter will be given prompt attention.
If you fail to follow this simple procedure we cannot accept responsibility, as we would have been deprived of the opportunity to investigate the matter and hopefully rectify any problem.

28. Applicable law
This contract between us and these booking conditions are governed by and construed in accordance with Italian Law. Both parties agree to submit to the exclusive jurisdiction of the Court of Italy.
